1. Do They Work Directly With Your Defense Attorney?
A quality consultant works alongside your legal team, not independently. Red flag: a consultant who says they can "handle everything" without involving your attorney. The right answer: "We coordinate with your defense attorney on all pre-sentencing strategy. Our role is to extend your legal team's capacity."
2. What's Their Experience With Your Specific Charges?
Federal sentencing varies dramatically by offense type — white-collar, drug trafficking, and firearms cases each have different sentencing dynamics. Ask specifically about the types of cases handled, RDAP eligibility implications for your charge type, and designation considerations.
3. Do They Cover Sentence Mitigation — or Just Prison Prep?
The most consequential work happens before sentencing. The PSR is the document that controls your case for your entire incarceration — RDAP eligibility, BOP designation, and program access all flow from it. A consultant who only handles post-sentencing preparation shows up after the most important game has already been played.
4. Can They Help With RDAP and Early Release Programs?
RDAP is the most powerful early release mechanism available — up to 12 months off a sentence, which is 20% of a 5-year sentence. Eligibility is protected or lost during the pre-sentencing phase. Ask: "Do you understand RDAP eligibility, and can you help me document substance use history correctly before sentencing?"
5. What Support Do They Provide After Sentencing?
A consultant who disappears after sentencing doesn't understand how the system works. Post-sentencing work includes BOP designation letter submission, RDAP enrollment advocacy, First Step Act credits planning, halfway house positioning, and reentry planning. Ask for a specific breakdown of what post-sentencing support looks like.
